A presumptive condition is one the VA automatically presumes is connected to your service based on where and when you served. If you have the condition and the qualifying service, you do not have to prove the link with a medical nexus — service connection is presumed.
The PACT Act added many conditions tied to toxic exposure — including numerous cancers and chronic respiratory illnesses — for veterans exposed to burn pits and other airborne hazards during Gulf War and post-9/11 service. It also expanded the Agent Orange and radiation presumptive lists.
You need two things: a current diagnosis of a listed condition, and qualifying service — the right dates and locations, such as service in a covered area during a covered period. Meet both and the VA presumes service connection.
Usually not. The purpose of a presumptive is that the VA already presumes the connection, so a nexus opinion generally is not required. You mainly need to establish your diagnosis and your qualifying service.
